Farmside Email Service – Terms & Conditions
The Farmside Email Service
1. The Farmside email service (“Email Service”) you receive from Farmside gives you usage of an @farmside.co.nz email address.
2. Your @farmside.co.nz email address comes with 1GB of storage. If you use all of this storage, you will need to delete emails to free up more storage and receive new emails.
3. You will need to call us on 0800 32 76 74 to sign up for Email Service. Your Email Service will be activated within 24 hours of you signing up for the service.
4. We can choose how we provide this Email Service to you and the technology used to supply it.
5. We may sometimes need to temporarily suspend the Email Service so that our suppliers can carry out maintenance and/or development work on the service. We will try to minimise any disruption to you (except in an emergency where this may not be practical). We cannot guarantee 24/7 access to your Email Service, as some of these outages/disruptions are out of our control.
6. We’ll take reasonable skill and care to provide the Email Service in a reasonable timeframe and to ensure the Email Service does what we say it will. We’ll do this as best we can, but there are some things we can’t control, such as the systems and technology we don’t own and the nature of these services. This means we can’t promise or guarantee that the Email Service will be continuous or fault free. We’ll always try to resolve any issues or restore an outage as soon as we reasonably can.
7. We also can’t guarantee the timeliness, delivery, retention or storage of any communication, personalised settings or the Email Service.
Your general responsibilities
8. You agree to not use the Email Service to:
· Email or otherwise transmit any content that’s unlawful, harmful, threatening, abusive, defamatory, invades another person’s privacy or is racially, sexually or ethnically objectionable;
· Email or otherwise transmit any content that you don’t have the right to transmit or that infringes any patent, trademark, copyright or proprietary rights;
· Email or otherwise transmit any content that contains software viruses or any other computer code that’s designed to interrupt or destroy the functionality of any computer software or hardware;
· Stalk or harass another person;
· Send “junk mail”, “spam” or similar forms of solicitation; or
· Use purchased, rented or third-party lists of email addresses.
9. You are responsible for any content, information or material you upload, download, post, email or otherwise transmit, access or make available through using the Email Service.
Email data retention and storage
10. You acknowledge that the services, the data and the information required to provide the Email Service will be managed and stored in either New Zealand or Australia.
11. The amount of email and data storage available to you on systems to provide you with Email Service is limited to 1GB and some email or data may not be processed due to space restraints.
12. You agree that it may be reasonably necessary for us to establish limits concerning use of the Email Service including, without limitation, the maximum number of email messages that may be sent from or received by a mailbox, the maximum size of any email message that may be sent from or received by a mailbox and the maximum mailbox size. Where we change or introduce new limits, we’ll give you as much warning as we reasonably can. If you don’t agree to the limits, you may cancel the Email Service as set out in these Terms.
13. Many factors can contribute to the deletion, corruption or failure to store information. For these reasons, Farmside can’t guarantee against the deletion, corruption or failure to store any content, information or material maintained or transmitted with the Email Service.
Charges
14. The charges for your Email Service will begin the day that you sign up for the service.
15. You will be charged each month as part of your monthly Farmside bill on your Email Service renewal date until you cancel your Email Service.
16. If you have a Farmside Broadband and/or Mobile service, there will be a cost of $5 per month for the Email Service. If you do not have any active services with Farmside, there will be a cost of $15 per month for the Email Service.
Cancelling your Email Service
17. You are not in a contract term for the Email Service.
18. If you wish to cancel your Email Service, you are required to give us 30 days notice. You can do this either by emailing customerservices@farmsideltd.co.nz or calling the Sales team on 0800 32 76 74.
19. If you do choose to cancel, your Email Service will be deactivated at the end of the 30 days notice period. This means from this point you won’t be able to sign in and your mailbox will stop receiving new emails. We want to give you an opportunity to retrieve your existing email data received prior to deactivation, so we will use our best efforts to hold this data for 60 days from the date your email is deactivated. After this, the information will be deleted from our systems and unrecoverable.
Privacy
20. Your privacy is important to us. Our Farmside Privacy Policy tell you how we manage your personal information. This section also includes further details specific to the Email Service.
21. When we provide the Email Service to you, we will collect and store data such as information about your usage of the email service, sign in timestamp information, , contacts, photos, documents or other personal files, including email content for the purposes of helping you with a request about your email (“Usage Information”). We only use Usage Information to deliver your Email Service and for security purposes.
22. We will also collect other information about you such as your first and last name, email address, phone number, security questions/answers, your Farmside account details, credit card details and system configuration preferences (“User Information”) when you first sign up to a service from Farmside including the Email Service. We will share Usage Information with our authorised email service provider to provide the Email Service to you. Other than that, we will only share Usage Information as set out in our Privacy Policy.
Usage Data
23. The following words in this section have the defined meaning set out below:

| End User Metadata | The metadata that exists in or about your use of the Email Service but does not include the content of your emails. |
| Legitimate Email Event | Creating, sending, using or interacting with legitimate email content that is not malicious. |
| Non-Legitimate Email Event | Any actual or suspected creation, sending, use or interaction with malicious content, including malware. |
| Usage Data | All data or information collected or created by Farmside or its authorised email service provider relating to your use of the Email Service, which is generated through the filtering and security measures in place within the Email Service (including authentication monitoring), including all click-through data and End User Metadata. Usage Data does not contain any data or email content generated in a Legitimate Email Event. Usage Data does however include data or email content in a Non-Legitimate Email Event. |
24. All Usage Data will vest in Farmside’s authorised email service provider or its nominee(s) as and when it comes into existence.
General
25. We may suspend or cancel your Email Service if it has been inactive for 12 months or more.
26. We may change, withhold, restrict, replace or cancel the Email Service. If acting reasonably you consider that such a change has a negative impact on your use of the Email Service, you may cancel your Email Service as set out in these Terms.
27. Any rights you may have under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 apply alongside the rights set out in these Terms, and aren’t affected or altered by them .
28. We understand that the Email Service may be used partially for business use. We are not liable for any loss of profits, revenue or any consequential, indirect or special damage for your business.
29. You may only bring any claims or issues related to the Email Service directly with Farmside, and not with any of our service providers.
30. We may change these Terms from time to time. The changes will be effective upon publishing revised Terms on our website. Your continued use of the Email Services constitutes your acceptance of the updated Terms.
31. Farmside’s Standard Terms and Conditions and Privacy Policy apply in addition to these Terms.
